Costas Sakkas, the 30-year-old self-proclaimed anarchist who spent two-and-a-half years in pretrial custody until his release in July, was granted conditional release by an Athens prosecutor on Tuesday following his re-arrest on Friday.

Sakkas has been charged with participation in the urban guerrilla group Conspiracy of the Cells of Fire though he denies any links to the organization, key members of which have been convicted and are serving prison sentences. He went on an extended hunger strike in the summer to protest his pretrial detention, which the law stipulates cannot exceed 18 months, after which he was granted conditional release in July

However, counter-terrorism officers re-arrested Sakkas on Friday after his fingerprints were identified as being at one of the safe houses used by the Conspiracy of the Cells of Fire in Halandri, northeastern Athens, some five years after the premises was raided.

In a written statement Sakkas argued that the fingerprints do not constitute damning evidence as they were found after his initial arrest in October 2010. He also reiterated claims that he was never a member of Conspiracy of the Cells of Fire, though he did admit to being on friendly terms with some of its members. He said that the new evidence is inadmissible and added that he has referred his case to the European Court of Human Rights.

He was ordered to pay bail of 5,000 euros, to remain in the region of Attica and to report at his local police precinct once a week.
